Welcome to SkyLend. We are committed to protecting your privacy and safeguarding your personal data. This Privacy Policy explains how we collect, use, disclose, store, and protect your personal information when you use our Services, in accordance with the Nigeria Data Protection Act (NDPA) 2023 and the Nigeria Data Protection Regulation (NDPR) 2019 .

By accessing or using our Services, downloading and using our Application, and providing your Personal Data to us, you agree to the collection, use, and storage of your information in accordance with this Privacy Policy.

 If you do not agree with any part of this Policy, please do not use our Services.

You have the right to contact us at any time to withdraw your consent to our continued collection and use of your Personal Data.

 


2. Definitions

For the purposes of this Privacy Policy:

•         Account means a unique account created for you to access the Services.

•         Application means the SkyLend mobile software provided by the Company and installed on your electronic device.

•         Company means SKYBYTE INNOVATION NIGERIA LIMITED, with its registered address at 350 Ikorodu Rd, Maryland, Ikeja, 100211, Nigeria.

•         Personal Data means any information relating to an identified or identifiable natural person.

•         Services means the SkyLend Application, website, and all related products and services.

•         You means the individual who accesses or uses the Services.

In accordance with applicable laws and regulations, we process your Personal Data based on one or more of the following legal grounds:

•         Consent : where you have provided explicit consent for specific purposes;

•         Contractual Necessity : where processing is necessary for the performance of a loan agreement between you and us;

•         Legal Obligation : where processing is required to comply with applicable legal or regulatory obligations;

•         Legitimate Interests : where processing is necessary for our legitimate business interests and does not override your fundamental rights and freedoms.

 


4. Collection and Use of Personal Data

To provide our Services, assess your creditworthiness, prevent fraud, and comply with regulatory requirements, we may collect information directly from you, from your device with your explicit authorization , and from lawful third-party sources.

4.1 Information You Provide to Us

(1) Personal Identification Information

Collected Data: Full name, date of birth, gender, marital status, number of dependents, highest education level, email address, phone number, and current residential address.

Purpose: Identity verification, fulfillment of Know Your Customer (KYC) obligations, and account- and loan-related communication.

(2) Employment and Financial Information

Collected Data: Employment type, monthly net income, and bank account details.

Purpose: Assessment of repayment capacity, verification of income stability, and loan disbursement to your designated bank account.

(3) Biometric Information

Collected Data: Selfie photographs, facial recognition data, and images of government-issued identification documents.

Purpose: Verification that the applicant is the legitimate holder of the identification documents and prevention of identity fraud.

 This data is used solely for identity verification and fraud prevention and is not used for marketing or advertising purposes .

(4) Emergency Contact Information

Collected Data: Names, relationship to you, and phone numbers of two emergency contacts.

Purpose: Identity verification and loan-related communication when you cannot be reached directly.

 You confirm that you have obtained the consent of your emergency contacts before providing their information.

(5) Loan Purpose

Collected Data: Description of the purpose of your loan application.

Purpose: Understanding user funding needs and internal statistical analysis.

 


4.2 Information Collected from Your Device with Explicit Authorization

a. SMS Data (Strictly Limited to Core Credit Functions)

When you actively initiate a loan application or credit assessment process, and only with your explicit authorization , we may perform a one-time access to SMS messages that are directly related to financial services .

Scope (Financial SMS Only):

•         Time Range: Up to the most recent 6 months

•         Maximum Quantity: No more than 2,000 messages

•         Data Fields: Sender identifier (e.g., bank or payment institution), financial transaction-related content, and received timestamp

Restrictions:

1.       Only SMS messages directly related to loans, repayments, or account transactions are processed;

2.       All non-financial SMS messages are automatically ignored and are not read or stored;

3.       One-time passwords (OTP) and private communications are not accessed;

4.       No continuous, background, or periodic access is performed.

Purpose (Core Functional Necessity):

1.       Credit assessment and repayment capacity analysis;

2.       Fraud detection and risk identification;

3.       Compliance with financial regulations and responsible lending requirements.

Data Security and Retention:

1.       Data is encrypted during transmission and processing;

2.       Retained only for the minimum time required for analysis, then deleted or anonymized;

3.       Not sold, shared, or used for advertising purposes.

 


b. Installed Application Information (Limited to Financial and Risk Assessment Purposes)

With your explicit authorization, we may collect limited application-related information relevant to credit risk evaluation.

Collected Fields: Application package name, application version, installation source, and installation time.

Principles:

1.       Used solely to identify abnormal device environments and potential fraud risks;

2.       No full application list is collected;

3.       No access to or analysis of in-app data;

4.       Not used for advertising, user profiling, or cross-application tracking.

Purpose:

•         Device and environment risk identification;

•         Fraud and abuse prevention, including detection of automated tools, malware, or mass registration activities.

 


c. Device Information

Collected Data: Device brand and model, operating system version, screen resolution, language/region settings, time zone, and device integrity status (e.g., root, jailbreak, emulator).

Purpose: Fraud prevention, detection of abnormal devices or emulator environments, and enhancement of account security.

 


d. Location Information (Non-Precise Location)

With your explicit authorization, and only at key loan process stages (such as application, review, or disbursement), we may collect approximate location information .

Scope:

1.       Country- or state-level location;

2.       Approximate area inferred from network or IP address.

Restrictions:

1.       No precise GPS location collection;

2.       No continuous or background location tracking;

3.       Not used for advertising or marketing purposes.

Purpose:

1.       Verification of service eligibility;

2.       Detection of abnormal access or potential fraud;

3.       Compliance with legal and regulatory obligations.

 


e. Wi-Fi Network Information

To protect account security, we may use limited network environment information for:

1.       Detection of high-risk or abnormal network environments;

2.       Prevention of fraud, account hijacking, or malicious access.

We do not track your browsing behavior or accessed content.

 


f. Camera and Photos

With your explicit authorization, we may access the camera and photo gallery to:

1.       Capture live selfie photographs;

2.       Capture or upload images of government-issued identification documents;

3.       Complete KYC identity verification and fraud prevention processes.

This access is limited to identity verification stages and is not used for advertising, marketing, or non-credit-related purposes.

 


User Control and Transparency

1.       All permissions are based on explicit and revocable user consent;

2.       Permissions are invoked only when necessary for core loan and account security functions;

3.       You may revoke permissions at any time through your device system settings;

4.       Revoking certain permissions may affect our ability to continue providing loan services.

 


4.3 Information from Third Parties

(1) Credit Bureaus and Financial Institutions

Collected Data: Credit scores, credit history, outstanding loans, repayment records, and other credit-related data.

Purpose: Credit assessment, prevention of over-indebtedness, and regulatory compliance.

(2) Public Records and Official Databases

Collected Data: Identity and status information obtained through government verification services, including NIN and BVN verification.

Purpose: Identity verification, document validation, and legal compliance.

 


5. Purposes of Processing

To the extent permitted by law, you agree that SkyLend may collect, process, analyze, store, disclose, transfer, and use your Personal Data for one or more of the following purposes:

(a) Service Provision and Loan Assessment

•         Evaluation and verification of loan applications, credit limits, and user information;

•         Provision of information to relevant third parties for registration, credit scoring, and identity verification;

•         Execution and management of loan agreements.

(b) Risk Management, Fraud Prevention, and Security

•         Statistical analysis, credit review, risk assessment, and anti-money laundering screening;

•         Monitoring, detection, prevention, and investigation of suspicious, fraudulent, or unlawful activities;

•         Maintenance of credit records for current and future reference.

(c) Communication and Marketing

•         Contacting emergency contacts when you cannot be reached;

•         Sending promotional information via SMS, WhatsApp, or email;

•         Sending loan-related reminders and notifications.

(d) Service Optimization and Business Operations

•         Development, management, and training of credit assessment models, including AI and machine learning models;

•         Market research, marketing effectiveness analysis, and product improvement;

•         Audits, investigations, and new product development.

(e) User Support and Legal Compliance

•         Identity verification, customer support, and complaint handling;

•         Compliance with legal, regulatory, and contractual obligations;

•         Other purposes with your separate consent.

 


6. Methods of Collection

We may collect Personal Data through:

•         Information you provide during registration;

•         Technical and transaction data automatically generated through your use of the Application;

•         Lawful third-party or public sources.

We explicitly confirm that:

•         We do not access or read your contacts, external storage, precise location data, or videos;

•         We do not use collected data beyond the purposes described in this Policy, except where required by law.

 


7. Sharing and Disclosure of Personal Data

We may disclose your Personal Data to:

•         SkyLend directors, officers, employees, or affiliates;

•         Authorized third-party service providers (e.g., payment processors, e-KYC providers, credit bureaus, fraud prevention partners, banks);

•         Judicial, regulatory, or government authorities;

•         Other third parties with your explicit authorization.

Any cross-border data transfers will comply with applicable laws and regulations.

We implement reasonable technical and organizational measures, including encryption and firewalls, to protect your Personal Data. However, no method of transmission over the Internet is completely secure. You are responsible for safeguarding your account credentials.
